Privacy Statement Insaver

1. Scope

This Privacy Statement applies to the processing of your personal data in the context of your contract with Insaver, in the context of prospecting by Insaver, and in the context of your use of the websites operated by Insaver (hereinafter referred to as “Websites”) in your capacity as a (potential) customer or visitor.

This Privacy Statement describes how your personal data is processed under the responsibility of Insaver and how such data may, if necessary, be transferred to third parties. Before making any use whatsoever of the Websites, you are required to read this Privacy Statement carefully.

By providing us with your personal data, you acknowledge that you have been informed of the terms and conditions set out below under which Insaver processes personal data. If you provide us with personal data relating to persons other than yourself, you warrant and guarantee that these conditions have been communicated to the data subjects concerned and that, to the extent that certain processing is based on consent, you have validly obtained the specific consent of the data subject for such processing by Insaver.

Insaver takes care of your privacy and strives to always act in accordance with the provisions of applicable data protection legislation (the “Data Protection Legislation”), including but not limited to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“General Data Protection Regulation” or “GDPR”) and the Belgian law of 31 July 2018, as well as any future amendments to such legislation.

Furthermore, Insaver has taken the necessary technical and organizational measures to secure your personal data and to protect it against unlawful processing.

3. Processing of Personal Data

Insaver collects and processes different categories of personal data in the context of your use of the Websites and in the context of certain services or the agreement we have with you.

3.1. Statistical Information

What data?
During each visit to the Websites, various personal data and log files concerning that visit or use may be collected, depending on your stated preferences. The collected data may include, among other things, your IP address, your location, the date and duration of your visit to the Websites, the websites from which you have been redirected to the Websites, your browser, your operating system, your browsing behavior on the Websites and, in particular, the pages you visit on the Websites, etc.

These data are used for statistical purposes, to analyze and optimize the operation and use of the Websites, and to optimize and improve the services provided by Insaver.

3.2. Customer Information

What data?
Including your identification data (such as name, place of residence, e-mail address, telephone number), personal characteristics (such as language, gender), housing characteristics (such as type of residence, duration of stay, age of residence), financial data (such as account number), contractual data (such as contract, customer history and, where applicable, company number), judicial data (data relating to convictions and judgments concerning non-payment of invoices), and energy consumption.

Source?
Insaver collects such personal data via the Websites but also in other ways, for example via digital or paper (registration) forms and contracts, by e-mail, telephone, SMS, social media, partners and third parties, public sources, etc.

Purposes?
These data are processed for, among other, the following purposes:

• to allow you to make use of functionalities offered via the Websites, such as (i) requesting a quote, (ii) contacting Insaver, (iii) participating in a contest, (iv) agreeing to receive periodic communications from Insaver, or (v) leaving your contact details;

• to confirm your request with Insaver, for the creation, acceptance and follow-up of your customer file, to provide and follow up on the requested products or services, for general customer management; for after-sales service and to conclude, perform, and manage various contracts;

• to collect statistical information and to compile trend analyses for financial, management, marketing, and reporting purposes;

• to establish a profile of customers and prospects, to centralize and combine customer (and prospect) data and to enrich it with relevant data in order to assist customers (and prospects) in the most efficient and personalized way possible;

• for bookkeeping, combating fraud, crimes and infringements, and the management of disputes and any legal proceedings;

• for the collection of invoices and the management of receivables, including the processing of and/or transfer of your data in the context of the transfer of receivables to third parties such as collection agencies or lawyers;

• to handle and, if applicable, respond to your question, communication, or request (e.g. to provide you with requested information about Insaver’s products or services);

• to allow you to participate in a contest and to inform you about its progress and outcome;

• to send you newsletters and personalized marketing via e-mail or other channels;

• to evaluate and improve our products and services.

Legal basis?
The processing of these personal data is based on:

(i) Insaver’s legal obligations under applicable legislation, including – but not limited to – our fiscal and accounting obligations, as well as our obligations under federal and regional energy legislation, consumer legislation, and insurance distribution legislation;

(ii) the legitimate interest that Insaver has in proper internal administration and organization, customer management, file follow-up, combating fraud, promotion and improvement of its products and services, collections, management of receivables, statistical purposes; and/or

(iii) the conclusion and performance of the agreement we have with you. Without providing these personal data, the agreement cannot be executed; and/or

(iv) your consent where this has been obtained, such as for sending newsletters and personalized marketing.

Retention period?
These personal data are retained as long as necessary for the above purposes and, where relevant, in accordance with statutory limitation periods.

Your contact details may be used for up to 16 months after the end of the contract to keep you informed about offers and/or promotions from Insaver. You can always object to this. We process this data on the basis of our legitimate interest.

3.3. Data relating to your energy consumption or equipment

What data?
Data that broadly relate to your energy consumption or equipment, including:

• Measurement data, i.e. data obtained by or based on a count or measurement by a measuring device (for example, indexes and meter readings, capacity, intake/injection, voltage data, etc.);

• Technical data, i.e. data describing the connection or the technical status and specifications of the electricity meter or gas meter (for example, connection address, brand, type of meter, year of manufacture, EAN number, etc.).

Source?
These data are obtained by or are based on a count or measurement by a measuring device, and are obtained via the distribution network operators or directly from yourself.

Purposes?
The provision of our services and functionalities, including but not limited to our digital metering services, e-mobility solutions, consulting your current energy consumption, gaining insight into the energy produced or consumed by various devices within your residence.
